1. ABOUT US AND THESE TERMS

This website, hakdhealth.com, is operated by HAKD HEALTH LIMITED, trading as HAKD Health ("HAKD Health", "we", "us" or "our"). We are registered in England and Wales under company number 15828577. Our registered office is Ebenezer House, 5a Poole Road, Bournemouth, Dorset, United Kingdom, BH2 5QJ.

These terms apply to use of our website and purchases made directly from us through it. Please read them before ordering and retain a copy. Any product-specific terms, subscription terms and promotional conditions will be provided before you place your order.

Nothing in these terms excludes or limits your statutory consumer rights. If another website policy conflicts with these terms, your statutory rights remain unaffected.

2. USING OUR WEBSITE AND YOUR ACCOUNT

You must have the legal capacity to enter into a purchase contract. If you are under 18, a parent or guardian must make the purchase on your behalf, subject to any product-specific age restrictions.

Please provide accurate contact, billing and delivery details and keep your account information current. Keep your login details secure and tell us promptly if you suspect unauthorised access. You are not responsible for account misuse caused by our failure to take reasonable care.

You must not misuse the website, introduce malicious software, attempt unauthorised access, infringe another person's rights or use the website for unlawful purposes. We may restrict access where reasonably necessary to protect the website or address misuse. This does not remove your rights concerning existing orders.

3. OUR PRODUCTS AND PRODUCT INFORMATION

We sell food supplements, accessories and digital content. Product descriptions, quantities, ingredients, directions and relevant warnings are provided on the product pages and/or packaging. Check them before purchasing and using a product.

We take reasonable care to describe products accurately. Images are illustrative and colours may vary slightly between screens, but products supplied must match their description and meet applicable consumer-law standards.

We may update products or stop offering them for future orders. We will not materially change an accepted order without your agreement, except where legally required or necessary for safety, in which case we will explain your options, including any right to a refund.

Food supplements are not a substitute for a varied, balanced diet and healthy lifestyle. Follow the product label and do not exceed the recommended daily intake. Keep supplements out of reach of children. Night Blend is not suitable during pregnancy or breastfeeding. Seek advice from a qualified healthcare professional before use if you take medication, have a medical condition or are unsure whether a product is suitable for you.

Our digital sleep guide and website information are educational and do not replace personalised medical advice. Individual experiences may vary. This does not limit any express product promise or your statutory rights.

4. ORDERS AND CONTRACT FORMATION

Placing an order is an offer to purchase the products selected. Our initial order acknowledgement confirms receipt of your order. We accept your order when we send a dispatch confirmation for physical goods or a confirmation providing access to purchased digital content, unless we expressly confirm acceptance earlier.

If we cannot accept or fulfil an order, we will tell you and refund any payment taken for the affected items without undue delay. Reasons may include unavailability, an obvious pricing error or reasonable concerns about fraud or payment authorisation.

If a pricing or description error affects your order, we will explain it and offer you the choice of proceeding on the correct basis or cancelling for a refund. We will not automatically charge you a higher amount.

Contact info@hakdhealth.com promptly if you need to correct an order or cancel before dispatch. If we cannot stop dispatch, any applicable cancellation and return rights still apply.

5. PRICES AND PAYMENT

The price, currency, delivery charges and any applicable taxes will be shown before you complete checkout. UK consumer prices include applicable taxes. Discounts apply only on the conditions stated when offered.

We accept the payment methods displayed at checkout. You must be authorised to use the payment method supplied. Payment is taken at checkout, except where a different arrangement is expressly stated before purchase or applies to recurring subscription payments.

Future price changes do not affect accepted one-off orders. Subscription price changes are addressed in section 8.

For international orders, any import duties or local charges that are not collected at checkout will be explained where applicable. Your statutory rights remain unaffected.

6. SHIPPING AND DELIVERY

Available delivery destinations, charges and estimated delivery times are shown at checkout or in the delivery information linked from our website. We will deliver within the agreed period or, if none is agreed, without undue delay and within 30 days of accepting your order unless we agree otherwise with you.

If a delay occurs, we will tell you as soon as reasonably possible. Your rights to set an additional delivery deadline or cancel for a refund where delivery obligations are not met remain unaffected.

For deliveries arranged by us, goods remain at our risk until they come into your physical possession or that of a person you identify to receive them. Different statutory rules may apply if you independently appoint a carrier we did not offer.

Please check your address carefully. Contact us if a parcel is missing, damaged or incorrect so we can investigate and provide the appropriate remedy.

7. CANCELLATIONS, RETURNS AND REFUNDS

Our Refund Policy is available at https://hakdhealth.com/policies/refund-policy. It must be read subject to the rights set out below and applicable consumer law.

For eligible online purchases of physical goods, you can cancel without giving a reason from the time you order until 14 days after delivery. For goods delivered separately under one order, the period generally runs from receipt of the last item. For a contract for regular delivery of goods over a defined period, the statutory period generally runs from receipt of the first delivery.

To cancel, email info@hakdhealth.com with a clear statement of your decision, your name and order details. You may also use the model cancellation form at the end of these terms, but it is not compulsory.

Return cancelled goods within 14 days of notifying us. Contact us for return instructions and the correct return address. You pay the direct return cost for a change-of-mind cancellation unless we agree otherwise. We cover reasonable return costs where required for faulty, damaged, incorrect or misdescribed goods.

You may inspect eligible goods as you would in a shop. We may deduct an amount for loss of value caused by handling beyond what is necessary to establish their nature, characteristics and functioning, where the law allows. Opening ordinary outer packaging does not by itself remove your cancellation rights.

The change-of-mind cancellation right does not apply to sealed goods that are unsuitable for return for genuine health protection or hygiene reasons once unsealed after delivery. This exception applies only where its legal conditions are met; it does not automatically apply to every supplement or accessory. Other statutory exceptions apply only where relevant and disclosed. Digital content is addressed in section 9.

For a qualifying cancellation of your whole order, we refund the price paid and any standard outward delivery charge. We do not have to refund the additional cost of an upgraded delivery option. Refunds are made to the original payment method, without a refund fee. For returned goods, we may withhold a refund until we receive them or evidence that they were sent back, whichever is earlier, and will refund within 14 days of that point. If no goods were supplied, we will refund within 14 days of receiving your cancellation notice.

If a product is faulty, damaged, incorrect or not as described, contact us at info@hakdhealth.com. You have the remedies provided by consumer law, which may include rejection and refund, repair or replacement. These rights are separate from change-of-mind rights and are not removed by opening or using a product.

8. SUBSCRIPTIONS

Where you select a subscription, the product, quantity, recurring price, payment frequency and delivery frequency will be shown before you subscribe and in your confirmation. By selecting the subscription and completing checkout, you authorise the agreed recurring charges until the subscription ends.

Minimum commitment: 1 month. Any minimum commitment must also be prominently disclosed before purchase and does not restrict statutory cancellation rights.

Manage, pause or cancel your subscription through the subscription management link provided in your subscription emails, or contact info@hakdhealth.com. Changes to the next scheduled renewal must be received before its scheduled charge. Any operational deadline must be clearly disclosed before purchase and must not be used to restrict statutory rights.

Cancellation stops future renewals in accordance with the disclosed terms. If a renewal has already been processed, contact us promptly; any cancellation, return or refund rights for that order remain unaffected. Pausing, skipping or cancelling is confirmed once the change is recorded; contact us if you do not receive confirmation or cannot access the portal.

If we propose to increase your recurring price or materially change the subscription, we will notify you in advance, explain when the change would take effect and give you a reasonable opportunity to cancel before it applies. We will not impose undisclosed recurring charges.

Any introductory discount, subscription gift or loyalty benefit is subject to the eligibility conditions disclosed before purchase. We will not impose an undisclosed charge or gift clawback when you cancel.

For a subscription forming a single contract for regular goods deliveries, statutory cooling-off rights generally run from the first delivery as described in section 7. Additional cancellation rights or contractual benefits will be honoured where applicable.

9. DIGITAL PRODUCTS

Digital products, including our sleep guide, are supplied electronically. The product page will state the format, delivery method and relevant device or software requirements before purchase. Contact info@hakdhealth.com if you do not receive access or cannot open the file.

You generally have 14 days from entering into the contract to cancel a digital-content purchase. If you want supply to begin during this period, we will ask for your express consent to immediate supply and your acknowledgement that you will lose the cancellation right once supply begins. We will confirm that consent and acknowledgement in a confirmation you can retain.

If we have not obtained the legally required consent, acknowledgement and confirmation, your cancellation rights are not removed merely because a file was delivered or downloaded. Applicable rights concerning faulty or misdescribed digital content remain unaffected.

Purchased digital content is licensed for your personal, non-commercial use. You may keep a personal copy and print it for your own use, but you must not redistribute, resell, share download access or publish it without our written permission, except where permitted by law.

10. INTELLECTUAL PROPERTY

Our branding, website content, photographs, videos, designs and digital materials are owned by us or licensed to us and protected by applicable intellectual property law. You may browse the website and use purchased products and content as permitted by these terms. Other reproduction or commercial use requires permission, except where the law allows it.

HAKD Health branding must not be used in a way that suggests an unauthorised endorsement or affiliation. Shopify and other third-party names and marks belong to their respective owners.

11. REVIEWS AND FEEDBACK

If you submit a review or other content for publication, you give us a non-exclusive, royalty-free licence to display and reproduce it for operating and promoting our products and services, subject to privacy law and any permissions legally required. You retain ownership of your content.

Reviews must reflect your honest experience. Do not submit unlawful content, impersonate another person or infringe others' rights. Disclose any incentive where relevant. We may moderate content for these reasons but will not alter a review's meaning to misrepresent customer experience.

12. THIRD-PARTY SERVICES AND SHOPIFY

Our store is hosted by Shopify. Purchases from this store are made directly from HAKD HEALTH LIMITED. Shopify provides the ecommerce platform and is not the seller of our products. This does not exclude liability or rights that cannot lawfully be excluded.

We may use third-party payment, subscription and delivery providers. Their relevant terms may apply to your use of their services, but using these providers does not remove our responsibilities to you as the seller.

Links to external websites are provided for convenience. We are not responsible for independently operated external content, but nothing in this section limits responsibility we have under applicable law.

13. PRIVACY

Shopify also processes personal information to operate its platform. Information about Shopify's practices is available at https://www.shopify.com/legal/privacy/app-users. We use personal information in accordance with applicable data protection law.

14. WEBSITE AVAILABILITY AND OUR RESPONSIBILITY

We take reasonable care in providing our website but cannot promise that it will always be available or free from technical errors. We may carry out maintenance or updates. This does not affect our obligations for accepted orders.

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the contract was made.

Products are supplied for private consumer use. We do not accept liability for business losses such as lost business profits, revenue or opportunities arising from consumer purchases, where the law permits that limitation.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where liability cannot be excluded, or any other liability or consumer right that cannot lawfully be excluded or restricted.

15. EVENTS OUTSIDE OUR REASONABLE CONTROL

If an event outside our reasonable control affects supply, we will contact you as soon as reasonably possible and take reasonable steps to reduce its effects. Your rights to cancel and obtain a refund where we cannot fulfil the contract remain unaffected.

16. CHANGES, TRANSFERS AND OTHER TERMS

The terms applying to a one-off order are those provided when you place it. Website updates do not retrospectively change an accepted order. Material subscription changes are handled under section 8.

If we transfer our rights or obligations to another organisation, we will ensure that your consumer rights are not reduced and notify you where required. Please contact us before transferring your contractual rights to another person.

If a provision is found unenforceable, the remaining provisions continue to apply. A delay in exercising a right does not mean that right is waived. No provision overrides a statement or promise that consumer law makes binding on us.

17. GOVERNING LAW AND COMPLAINTS

These terms are governed by the law of England and Wales. If you are a consumer living elsewhere, you retain any mandatory protections available under the law of your country of residence.

Disputes may be brought in the courts of England and Wales. Consumers living in Scotland or Northern Ireland may also bring proceedings in the courts of their home jurisdiction, and other mandatory jurisdiction rights remain unaffected.

If you have a complaint, contact info@hakdhealth.com with your order details and the issue so we can try to resolve it. If we cannot resolve a complaint, we will provide information about an appropriate alternative dispute resolution body and state whether we are willing or obliged to use it, where required by law.
